Halozyme wins court order to block Merck’s injected Keytruda in select European markets

Halozyme said the ruling covers eight markets and leaves Merck’s intravenous Keytruda available to patients.

  • On Wednesday, a Dutch patent court in The Hague ordered Merck to halt the manufacture and sale of Keytruda SC in eight European markets, ruling the drug infringes on a Halozyme patent.
  • The decision stems from Halozyme's claim that Merck's injectable Keytruda SC infringes its EP 2,797,622 patent, which covers technology enabling rapid, high-volume subcutaneous drug delivery.
  • Keytruda SC accounted for $463 million of total Keytruda sales in the second quarter, yet patients retain access to the original intravenous formulation, which remains unaffected by the injunction.
  • Mark Snyder, Chief Legal Officer of Halozyme, said, "We're very pleased the Dutch court recognized the validity and infringement of Halozyme's MDASE patent," noting the ruling halts Merck's European launch.
  • Following a preliminary injunction in Germany on December 4, 2025, Halozyme continues its global enforcement strategy, including pending patent litigation against Merck in U.S. federal district court.
