Former UK equality chief questions Sandie Peggie tribunal ruling
The tribunal found NHS Fife harassed nurse Sandie Peggie over objections to a transgender doctor's use of a female changing room; other claims were dismissed.
- On Monday, the employment tribunal in Dundee found NHS Fife harassed Ms Peggie in a 300-page judgment, dismissing other claims.
- Peggie objected to Dr Beth Upton, a biological male who identifies as a woman, using a female changing room and was suspended after Dr Upton complained at Victoria Hospital in Kirkcaldy.
- The tribunal dismissed Peggie’s discrimination and victimisation claims and rejected all claims against Dr Beth Upton, while Judge Sandy Kemp suggested access to single-sex changing rooms could depend on presentation.
- A separate remedy hearing will decide compensation for Peggie, and all parties have until December 22 to appeal; NHS Fife’s liability under CNORIS is limited to £25,000 despite legal fees exceeding £400,000.
- The EHRC has replaced interim guidance with a proposed code, which ministers must sign off, and Bridget Phillipson said her government is `carefully considering` it.
