- The Labour Relations Board denied an application from Claudette Jackson, who claimed The Hospital Employees' Union failed to provide fair representation after her termination for refusing COVID-19 vaccinations.
- DCMS Realty terminated Jackson on Oct. 26, 2021, for refusing the vaccine, following a provincial health order mandating staff in long-term care facilities like Orchard Manor be vaccinated by Oct. 12, 2021.
- Although The Hospital Employees' Union filed a grievance, Jackson demanded they include 194.5 hours of banked sick time in a settlement offer the employer refused to renegotiate.
- In December 2022, the Union exercised its right to settle the grievance on Jackson's behalf, and the union director denied her appeal on Jan. 27, 2023.
- The BCLRB ruled the Union acted within its scope as an exclusive bargaining agent, finding it was honest with Jackson and did not discriminate against her for refusing the COVID-19 vaccine.
