Anti-Abortion Groups Worry Hyde Amendment’s 50-Year Run Could End with New Congressional Majority
Anti-abortion advocates fear a pro-abortion majority could revive repeal efforts as 21 states already let Medicaid cover abortions, KFF said.
- With Democrats potentially taking congressional majorities in January, anti-abortion advocates fear the most serious threat to the Hyde Amendment since 2022. Gavin Oxley, spokesperson for Americans United for Life, warned that a pro-abortion majority could prioritize repealing the long-standing funding restriction.
- First passed on September 30, 1976, the Hyde Amendment restricts federal Medicaid dollars from paying for abortion care except in limited cases. Named for Republican Congressman Henry Hyde of Illinois, the clause marked an early legislative victory for anti-abortion groups.
- Dr. Diane Horvath of Partners in Abortion Care reported a $1.2 million loss after accepting state Medicaid patients for a year and a half. The clinic loses at least $4,000 per patient due to low reimbursement rates for care beyond the second trimester.
- Public opinion remains divided: a 2015 poll found 62% of voters supported Medicaid coverage for abortions, while a 2016 Politico survey found 58% opposed it. This split reflects broader disagreement over whether to codify Hyde into law or pursue its repeal.
- Abortion opponents claim the Hyde Amendment has prevented 2.7 million abortions, even as access remains limited in more than a dozen states. Any legislative change faces a tall order, requiring 60 votes in the Senate to overcome filibuster rules in a polarized environment.
