According to a ruling by the European Court of Justice, nursing homes are allowed to broadcast radio and television programs to their residents without additional GEMA fees. The ruling sets a precedent. By Klaus Hempel.
Important decision from Luxembourg: Senior residences may transmit television and radio programmes received by satellite to the rooms of their residents without requiring an additional licence. This was decided by the European Court of Justice. Dispute over television in the Senior Home The starting point was a dispute between the Gema and the operator of a Senior Residence in Rhineland-Palatinate.
Does every resident of a nursing home have to pay GEMA fees? The European Court of Justice says no: it is not a public performance. The Federal Constitutional Court in Karlsruhe is also still considering the matter.
