This was decided by the European Court of Justice. Dispute over television in the Senior Home The starting point was a dispute between the Gema and the operator of a Senior Residence in Rhineland-Palatinate.

Does every resident of a nursing home have to pay GEMA fees? The European Court of Justice says no: it is not a public performance. The Federal Constitutional Court in Karlsruhe is also still considering the matter.
