This was stated by the Constitutional Court when it did not hear the complaint of the relatives of a woman who died in a hospital in Šumperk. Although the doctors made mistakes in the case, according to the judiciary, it was not possible to prove that their mistake was directly related to the woman's death.

Not every medical error gives rise to a claim for compensation. This was stated by the Constitutional Court (ÚS), which dealt with the case of the death of a woman in a hospital in Šumperk. Although the medical staff made a mistake, a direct connection with the patient's death could not be proven. The Constitutional Court therefore rejected the complaint of the six survivors as manifestly unfounded.
