Dallas Cowboys Cheerleaders Sue My Chemical Romance
The company says the band’s use of lookalike uniforms confused audiences and threatens irreparable harm to the Dallas Cowboys Cheerleaders brand.
On Friday, Pro Silver Star Ltd, owner of the Dallas Cowboys Cheerleaders, filed for a temporary restraining order and injunction against My Chemical Romance, alleging the band's recent Hollywood Bowl performance degraded the brand.
During the October 21 concert at the Hollywood Bowl, dancers wearing outfits resembling the 'DCC Uniform' performed choreography before engaging in a staged firefight with rifles, according to court documents.
Pro Silver Star argues the outfit 'is protectable trade dress that no one may use without DCC's permission,' claiming audience members mistook the dancers for the real squad and that MCR refused previous requests to stop.
Attorney Alex Spiro, representing the company, warned that continued use of the costumes risks 'irreparable harm to the reputation and goodwill Silver Star has cultivated in the DCC brand,' prompting immediate court intervention.
My Chemical Romance is scheduled for additional performances today, October 24, and October 30 and 31, while no ruling on the company's request for an injunction has been reported and the band has not publicly responded.
