14 Years and an Acquittal Later, SC Orders Fresh Probe in 2012 Karnataka Rape-Murder Case
The court said earlier probes by local police, the Karnataka CID and the Central Bureau of Investigation failed to secure a fair investigation.
- On Monday, the Supreme Court ordered the Karnataka government to constitute a Special Investigation Team for a fresh probe into the 2012 rape and murder of a 17-year-old girl in Dharmasthala, citing shocking investigative failures.
- The student went missing on October 9, 2012, in Ujire near Dharmasthala, and her body was found the next day with evidence of sexual assault; previous investigations by local police, the Karnataka CID, and the CBI failed to secure conviction.
- A bench comprising Justices Sanjay Kumar and Sanjeev Sachdeva directed the fresh investigation to conclude within three months, mandating that no officer from the Belthangady Police Station, CID, or CBI may join the new Special Investigation Team.
- While ordering the new inquiry, the court clarified that Santhosh Rao, acquitted by a CBI special court in June 2023, shall not be subjected to further investigation or prosecution under the Constitution's protections.
- Justice Sachdeva emphasized that a fair investigation is "as much a part of a constitutional right guaranteed under Article 21 of the Constitution as a fair trial," without which trials cannot be fair.
