Setback for Ex-CM Pinarayi Vijayan, Others as Kerala HC Denies Plea to Challenge Order in CMRL Case

The bench said the October 9 order did not bar the family from challenging the FIR through other legal remedies.

  • On Thursday, the Kerala High Court rejected an appeal by former Keralam Chief Minister Pinarayi Vijayan, his daughter Veena, and son-in-law Muhammed Riyas, upholding an October 9 order directing FIR registration in the alleged CMRL bribery case.
  • Last month, the Enforcement Directorate recommended an FIR regarding alleged illegal payments from Kochi-based Cochin Minerals and Rutile Limited to Veena's firm, Exalogic Solutions; the Congress-led government initially ordered a preliminary Crime Branch inquiry instead.
  • In their appeals, Vijayan, Veena, and Riyas claimed the single judge did not hear them before issuing the October 9 directive. The Bench stated the order "has not affected the applicants' rights to pursue the constitutional statutory remedy against the registration of the FIR."
  • Justices K. Natarajan and Johnson John dismissed all applications seeking leave to appeal the decision. The Vigilance and Anti-Corruption Bureau has constituted Special Investigation Teams to handle the CMRL-Exalogic corruption cases.
  • The court reserved its order on October 13, and a detailed judgment is awaited as the state proceeds with FIR registration in the corruption investigation.
