City of Kelowna responds to class action suit by evacuated low-income residents

The City of Kelowna acknowledged that the downtown construction of the new University of BC Okanagan campus caused damage to neighboring properties, "but the precise mechanisms, types and magnitude of such damage is not presently understood by the city."
A class action lawsuit alleges negligence by the City of Kelowna, claiming a breach of duty of care in protecting against hazardous conditions during construction.
Kelowna denies the allegations, stating it had no prior knowledge of damages before being notified on Nov. 27, 2023, and "did not owe the plaintiffs or class members a duty to warn.
