Lawyers for Lively, Baldoni Back in Court over Damages
Lawyers for both sides dispute whether Blake Lively can recover damages and legal fees after a settlement ended her sexual harassment claims.
The legal battle between actors Blake Lively and Justin Baldoni returned to a New York court despite a settlement reached in early May, with a dispute over legal fees persisting regarding their 2024 film.
Lively had alleged sexual harassment during filming, while Baldoni's countersuit for defamation and extortion was dismissed last year; the parties settled in May, agreeing her concerns 'deserved to be heard.'
Lawyer Ellyn Garofalo, representing Baldoni, told US District Judge Lewis J. Liman that Lively's fee application is 'effectively an end run around the jury trial' that was voided by the deal.
Representing Lively, lawyer Michael Gottlieb contends California law permits 'significant' penalties against parties who file unsuccessful retaliatory defamation actions, asserting Baldoni's lawsuit was precisely what the law was designed to stop.
US District Judge Lewis J. Liman heard more than an hour of arguments on Tuesday but did not immediately rule on the fee application, leaving the dispute unresolved.
