More than 6,000 Black workers at Tesla's Fremont plant must pursue individual claims after a judge ruled plaintiffs' attorneys failed to secure enough willing witnesses, court records show.
- On Friday, California Superior Court Judge Peter Borkon ruled the case could not proceed as a class, barring more than 6,000 Fremont Black workers and reversing the 2024 class-certification.
- California Superior Court Judge Peter Borkon said plaintiffs' attorneys failed to find 200 willing witnesses, with Organ stating `Either together with other victims, or separately, these courageous Black workers will overcome Tesla's endless delays and continue fighting to hold the company accountable.`
- The complaint began with a single employee who said Marcus Vaughn alleged Black workers faced slurs, graffiti and nooses at Tesla Fremont production floor and was fired after human resources complaints.
- With class status gone, each plaintiff must file individually as plaintiffs' lawyers have filed more than 500 suits and plan more than 900, Bryan J. Schwartz said Tesla faces hundreds of claims.
- Separately, Tesla faces federal EEOC litigation and state civil rights agency suits, and the company says it fires employees for racial misconduct, while Reuters calls the ruling a meaningful legal victory but notes ongoing lawsuits.
