Auditor signals plans for records lawsuit against Massport
Auditor DiZoglio alleges Massport used confidentiality clauses and Fair Information Practices Act notices to block access to personnel records amid a $1.375 million settlement audit.
- State Auditor Diana DiZoglio said Wednesday she plans to sue the Massachusetts Port Authority, while Massport said it first learned of the lawsuit at her State House press conference.
- The audit of 21 state agencies found at least 263 settlement agreements from Jan. 1, 2019 through Dec. 31, 2024 totaling about $6.8 million, including a $1.375 million Massport settlement .
- Under FIPA, Massachusetts Port Authority notified more than 100 current and former employees, ten objected, and auditors received only a list of those objectors and dates.
- Citing a conflict of interest, Diana DiZoglio, State Auditor, said she will hire outside counsel to sue Massport, notifying Andrea J. Campbell, Attorney General, on Wednesday morning and warning state agencies invoking FIPA set a dangerous precedent.
- Last year, Governor Maura Healey issued a policy banning non-disclosure agreements across the executive branch, and Massport says it adopted a no-NDA policy consistent with that guidance.
