Partial Acquittal for Asaram by Rajasthan High Court
The court set aside gang-rape convictions but kept a life sentence for rape of a minor and ordered Asaram to surrender.
On Wednesday, the Rajasthan High Court in Jodhpur upheld Asaram's life imprisonment for rape of a minor, directing the former self-styled godman to surrender immediately after acquitting him of gang rape charges.
Asaram was originally convicted on April 25, 2018, for sexually assaulting a minor student at his ashram and sentenced to life imprisonment under multiple IPC and POCSO Act provisions; the appellate bench reserved its verdict on April 20 after completing hearings.
The High Court maintained convictions under Sections 342, 370, 506, 509, and 354 of the IPC, plus Sections 7/8 of the POCSO Act and Section 23 of the Juvenile Justice Act, while upholding Section 34 of the POCSO Act charges.
Despite a seven-day bail extension granted Monday, the court ordered Asaram to surrender; before announcing its decision, the bench remarked it had a 'mixed bag' of good and bad news for the accused.
Asaram secured partial relief through acquittals on IPC Section 376 and POCSO Act Sections 5/6, and was discharged under Section 120 for criminal conspiracy, while co-accused Sanchita Gupta alias Shilpi and Sharat Chandra were acquitted of their earlier convictions.
