Can one refuse to pay the broadcasting fee if the public-law programme does not appear to be diverse enough? In a fundamental judgment, the Federal Administrative Court has established high hurdles for this. By F. Graucht and P. Raillon.
Because of allegedly »missing programme diversity«, a woman does not want to pay a broadcasting fee. The Federal Administrative Court now decided: The hurdles for successful lawsuits are quite high.
The broadcasting contribution could be unconstitutional – but the hurdles are high. With the ruling of the Federal Administrative Court, the dispute goes into prolongation.
A woman defends herself in court against the payment of broadcasting fees. As an argument she argues that the programme is neither balanced nor varied. In the preliminary instances the plaintiff fails. The Federal Administrative Court cancels the final judgment in the revision. It is open how it goes on now.
