Absence From Draft SIR Doesn't Mean Deletion, ECI Tells Bombay HC
The commission said the draft roll reflects fresh enumeration, and six family members must use Form 6 to be added, not Form 8.
- On Tuesday, The High Court of Bombay at Goa reserved its verdict on a petition by Paresh Salgaoncar, whose family members were excluded from electoral rolls after their Form 8 applications were rejected.
- Unlike the routine Special Summary Revision , the Special Intensive Revision requires electoral rolls to be prepared afresh, The Election Commission explained, meaning existing rolls are not carried forward.
- The Booth Level Officers instructed Salgaoncar and his five family members, who moved to the Santa Cruz Assembly constituency eight years ago, to use Form 8, which the commission now claims is inapplicable.
- Senior Advocate Ashutosh Kumbhakoni, representing The Election Commission, argued that excluded individuals must file Form 6 as new voters, telling the court they are, "Not dealing with the process of SIR."
- Justices Amit S Jamsandekar and Valmiki Menezes questioned why Form 8 is not accepted during the SIR, as the court considers whether the process effectively denies restoration of existing Electors Photo Identity Cards.
