Court: Florida violates Americans with Disabilities Act by institutionalizing disabled kids
The U.S. District Court for the Southern District of Florida ruled that the State of Florida is violating children's rights by forcing those with serious and complex medical conditions to be institutionalized in nursing facilities.
The court found that Florida placed some children at serious risk of unnecessary institutionalization and kept others unnecessarily institutionalized.
The ruling requires Florida to ensure that children with complex medical needs have access to essential services in their own communities and develop transition plans for institutionalized children.
