US Supreme Court denies immigration judges the power to shelve deportation cases
The unsigned order keeps a nationwide block on a Biden-era rule that let immigration judges pause deportation cases, after challengers cited collusion.
- On Tuesday, the Supreme Court allowed a deportation settlement between President Donald Trump's administration and Texas to remain in force, rejecting an emergency request without explanation.
- The settlement effectively terminates a federal regulation that allowed immigration judges to pause deportation proceedings for vulnerable individuals such as neglected children or violent-crime survivors. The Justice Department agreed to set aside the rule.
- Baltimore, Columbus, and New Haven, along with Centro Legal and Raza, challenged the settlement as "egregious collusion," arguing it bypassed public participation and APA rulemaking requirements.
- District Judge Reed O'Connor approved the settlement the same day. Solicitor D. John Sauer argued the challengers' request "attempts to improperly leverage a clear-cut dispute over intervention into a far-reaching attack on the merits of a consent judgment."
- Connor previously ruled the challengers lacked legal standing because they were not directly affected by the settlement. The case remains pending at the 5th Circuit Court of Appeals.
