US states challenge FAA environmental review of commercial drone package rules
The states say the FAA’s review ignored safety and environmental risks as drone delivery could expand beyond visual line of sight.
On Monday, Fifteen states and Harris County, Texas, sued the Federal Aviation Administration in the U.S. Court of Appeals for the Second Circuit over its environmental review of planned commercial drone package delivery rules.
The FAA signed a finding of "No significant impact" on July 28, 2026, which the states argue failed to "adequately address the potential safety risks or other environmental impacts."
California Attorney General Rob Bonta said the "FAA's programmatic environmental assessment falls far short of properly analyzing the environmental impacts that drone package delivery operations may have," while residents in Richardson, Texas, report constant noise disruptions from Amazon operations.
Defending its Prime Air service, Amazon stated that fewer than 1% of inquiries this year concerned noise, describing the sound as brief and comparable to a low window fan or passing car.
The FAA intends to use the assessment when considering individual operator applications, though additional environmental analysis may still be required for particular projects as hub locations become known.
