UPS Put Profits over Safety Before Plane Crash that Killed 14, Lawyer Alleges

Two lawsuits allege negligence by UPS, manufacturers, and maintenance firms after fatigue cracks caused engine detachment and crash killing 14, attorneys said.

  • On Dec. 3, Clifford Law Offices of Chicago and Louisville attorney Sam Aguiar will file two wrongful-death lawsuits for families of Angela Anderson and Trinadette "Trina" Chavez after the Nov. 4 crash of UPS Flight 2976.
  • On Nov. 20, the NTSB preliminary report found the left engine and left pylon detached during takeoff and investigators reported fatigue cracks and overstress failure in left pylon aft mount lug fractures.
  • Investigators say the MD-11 climbed only 30 feet before crashing into an industrial park just south of Louisville Muhammad Ali International Airport, carrying approximately 38,000 gallons of jet fuel that fueled the fire.
  • UPS said its MD-11 fleet, about 9% of UPS Airlines, will undergo inspections and repairs, with about 150 workers still on site, and the planes may remain grounded for several months.
  • Beyond the initial suits, attorneys say they will name UPS, UPS Air, GE, Boeing , and VT San Antonio Aerospace Inc. , while Morgan & Morgan filed a separate class-action.
