Toronto-Area Cops Who Failed to Breathalyze Drunk Driver Before Crash that Killed 3 People Won’t Face Charges: SIU
The Special Investigations Unit found no criminal negligence but flagged possible misconduct by two officers who failed to test an impaired driver that caused a triple fatal crash.
- The Special Investigations Unit announced Monday that two Halton Regional Police Service officers will not face criminal charges after SIU Director Joseph Martino said there are no reasonable grounds to believe either committed an offence, despite the deadly outcome.
- Initial traffic contacts began around 1:35 a.m. at a McDonald’s at Derry Road and Santa Maria Boulevard, Milton, where officers spoke with the 18-year-old driver but conducted no sobriety exam and allowed him to leave before the fatal March 30, 2024 crash.
- A technical collision investigation found the Infiniti was traveling 140-154 km/h, both vehicles caught fire, and blood analysis showed the 18-year-old was three times the legal limit.
- Joseph Martino, SIU Director, will refer the case to the Halton Regional Police Service chief and notify the Law Enforcement Complaints Agency, citing possible misconduct under the Police Code of Conduct.
- The SIU was not notified until July 22, 2024, nearly four months after the crash, so no physical evidence was collected; neither subject officer participated or provided notes, and McDonald’s video showed the driver stumbling while the in-car camera microphone was deactivated.
