The High Court of Justice of the Basque Country (TSJPV) has denied temporary incapacity benefit (IT) to a woman who went to a private clinic in Bilbao to undergo an abdominoplasty and liposuction for aesthetic reasons and who subsequently started a job leave. The court considers that, in the absence of a prior pathology justifying the intervention, purely aesthetic surgery does not give rise to the right to an IT subsidy.
