FCC Ends Challenge to Afridi's Appointment
The court said the challenge was moot after emergency measures and Governor’s Rule changed the chief minister’s status, making the disqualification plea ineffective.
On Thursday, the Federal Constitutional Court dismissed MNA Sher Afzal Marwat's petition challenging the appointment of Khyber Pakhtunkhwa Chief Minister Sohail Afridi, declaring it infructuous following emergency and governor's rule.
The federal government imposed governor's rule and an emergency in K-P on Sunday, citing the provincial government's "deliberate disengagement" from terrorism efforts, resulting in Afridi's preventive custody.
A two-member bench headed by FCC Chief Justice Aminuddin Khan, which included Justice Ali Baqar Najafi, observed that proceedings could not move forward because Afridi is not currently holding office.
Marwat requested an adjournment to challenge the emergency, arguing Afridi could be restored if the rule is lifted; Justice Ali Baqar Najafi ruled the petition against the now non-functional chief minister is no longer a live issue.
Senator Faisal Vawda stated the newly formed Advisory Council has 180 days to demonstrate performance, adding that if Governor Faisal Karim Kundi delivers even 10 per cent of expected results, the public will move forward.
