Kalshi could be headed for Supreme Court showdown, CEO says
States say Kalshi’s sports contracts are gambling, while the company says federal derivatives law should control and a Supreme Court fight could follow.
Kalshi CEO Tarek Mansour said the prediction market's legal battle with U.S. states could reach the Supreme Court, as New Jersey has requested a high court review following a recent appeals court victory for the platform.
Dozens of states contend Kalshi's sports-related trades constitute gambling subject to state laws and taxes, while the company argues these contracts are financial derivatives under federal oversight by the Commodity Futures Trading Commission .
Mansour expressed confidence in the company's legal position, stating, "I think the process will play out the way it's going to play out," as the platform's valuation has grown to around $40 billion.
A Supreme Court victory could cement Kalshi's position against traditional exchange heavyweights like CME Group and the Intercontinental Exchange, whereas a defeat would leave the company vulnerable to state control and crimp profits.
While sports betting currently accounts for 65% of Kalshi's revenue, this figure has declined from around 95% nine months ago, reflecting the platform's broader push to become a comprehensive trading exchange for diverse asset classes.
