LINCOLN, Neb. — A Lancaster County district judge dismissed an effort from the loser of the Democratic Senate race trying to force the Nebraska Democratic Party to replace its nominee who dropped out.

Judge backs Nebraska Democratic Party in U.S. Senate vacancy lawsuit

A Lancaster County district court judge ruled the Nebraska Democratic Party does not have to nominate a new candidate for Senate.

"In sum, under the plain language of Nebraska State Statute 32-623, a political party has the discretion to fill a vacancy after a candidate declines their nomination," the judge ruled.
