Iranian man says ICE detention in NM is unlawful
Hamid Ziaei challenges his detention after ICE ignored a judge's ruling protecting him from deportation due to likely persecution in Iran, legal counsel said.
- On Monday, Dec. 15, Hamid Ziaei and legal counsel appeared in federal court in Albuquerque with a habeas corpus petition asserting unlawful detention after ICE held him since June at Torrance County Detention Facility.
- An immigration judge previously found Ziaei would likely face persecution if returned to Iran and allowed him to stay under conditions after arriving in San Diego, California, in January 2024.
- Prolonged detention has left Hamid Ziaei with anxiety, panic attacks, deferred dental work for three tooth infections, weight and muscle loss, and Innovation Law Lab attorneys argue this violates due process with no removal evidence.
- U.S. District Court Judge Matthew Garcia said he would issue an order for Ziaei's release within 24 hours, attorneys Landry and Wang said, while the judge could also seek more time or consider deportation.
- U.S. Immigration and Customs Enforcement told the court it can take at least six months to arrange removal under a 2001 U.S. Supreme Court ruling, with no alternate country named, while return to Iran is barred.
