Peltola campaign sues Alaska to get records on rejected absentee ballots
The campaign says early disclosure is needed to protect ballot accuracy and prevent supporters from being disenfranchised.
On Friday, Alaskans For Mary sued the Alaska Division of Elections in Anchorage Superior Court, seeking to make public the names of voters whose absentee ballots were rejected in the November 3 election.
The campaign requested records under the Alaska Public Records Act on October 27 and again on November 4 but received no response and was later denied immediate access.
With about 600 votes separating Peltola and Republican incumbent Senator Dan Sullivan, the campaign argues it "cannot ensure that its voters' lawful votes were properly counted" without the rejected ballot data.
Plaintiffs seek a temporary restraining order and preliminary injunction to compel immediate disclosure, though the Alaska Department of Law said the agency will fight the lawsuit to protect ballot processing timelines.
The litigation follows a dismissed federal case involving namesake challenger Dan J. Sullivan, while ranked choice tabulation is scheduled for November 18 and certification is set for later this month.
