The last four misdemeanor proceedings conducted by the KPK against ministers from the previous Janša government have been concluded. Upon the expiration of their mandate, they requested compensation for unused vacation, but did not recuse themselves from the decision-making process.
While former ministers Hojs and Počivalšek received fines for conflict of interest, some of the ministers' cases in court have expired. The KPK warns of inconsistent case law, which leads to completely different final outcomes in identical circumstances.
The court upheld the KPK's decision that former ministers Aleš Hojs and Zdravko Počivalšek found themselves in a conflict of interest in the case of compensation for unused vacation, and that the proceedings against former ministers Marjan Dikaučič and Andrej Vizjak were time-barred. According to the Corruption Prevention Commission (KPK), the case raises the issue of inconsistent case law and the effectiveness of the rule of law.
