Fortescue Faces Legal Storm Over Alleged Rampant Sexual Harassment at Mining Sites
On Thursday, law firm JGA Saddler filed a landmark class action in the Federal Court in Melbourne against mining giant Fortescue Metals Group, alleging widespread sexual harassment, violence, and discrimination at the company's remote Pilbara sites.
This lawsuit follows similar 2024 class actions against BHP and Rio Tinto, as employees allege a toxic culture where women face sexual assault, stalking, and retaliation for reporting misconduct in remote work environments.
JGA Saddler lawyer Paris Hamrey included 45 testimonials in the filing, describing incidents ranging from sexual assaults to micro-aggressions, including reports of underwear theft and women being warned against using on-site laundries.
A Fortescue spokesperson stated it was inappropriate to comment on active proceedings, while emphasizing the company "is committed to providing a safe, respectful and inclusive workplace" after spending $300 million on site security upgrades.
Under the Sex Discrimination Act, employers face liability for permitting unsafe environments; Hamrey noted women fear blacklisting, with many reporting they were "silenced, dismissed or in worst cases, they are forced out of their job.
