Nigeria: Court Bars NMDPRA From Shutting Down, Interfering With Dangote Refinery

- On Monday, Justice Akintayo Aluko of the Federal High Court issued an interim injunction restraining the Nigerian Midstream and Downstream Petroleum Regulatory Authority from enforcing a directive suspending operations at Dangote Petroleum Refinery and Petrochemicals FZE in Lagos.
- The NMDPRA's August 24 directive aimed to halt loading and truck-out activities, but Dangote Refinery challenged this, citing an Attorney-General of the Federation letter dated March 2, 2026, which states regulators lack oversight over free trade zones.
- Depositions in Dangote's affidavit disclosed "serious issues for determination", prompting judicial intervention to "preserve the res". The 700,000-barrel-per-day refinery contends that current regulations prohibit suspension of its essential operations.
- Barring the NMDPRA from sealing facilities at the Lekki Free Zone, the injunction remains active pending the motion's hearing. Dangote must submit a formal undertaking to indemnify the regulator for damages should the order be overturned.
- The case awaits further hearing on September 9, 2026. Separately, a lawsuit involving NNPC Limited's fuel import licenses remains adjourned until October 7 due to the presiding judge's absence.
