A Massachusetts Catholic nonprofit has sued a Cape Cod zoning board for rescinding a building permit that would have allowed it to move a homeless shelter a block away from an elementary school.

According to the complaint, the Zoning Board of Appeals of Banstable, Mass., stated that "there needs to be an overt religious act, and it can't be only that the motivation is religious."
