Qualcomm and Arm head to trial again, potential for huge damages in focus
Qualcomm alleges Arm withheld contractually required testing tools and leaked a termination threat that hurt talks with Meta Platforms, as the dispute returns to court.
On Monday, Chipmaker Qualcomm and Arm Holdings returned to federal court in Delaware, with Qualcomm alleging Arm withheld chip testing tools and leaked a termination threat that undermined business negotiations with Meta Platforms.
Litigation between the two firms began in 2022, when Arm sued over a license agreement tied to Qualcomm's acquisition of Nuvia; Arm, owned by Japan's SoftBank Group, has since entered the chip market, turning former customers into direct rivals.
Seeking relief, Qualcomm aims to halt royalty payments to Arm for up to five years, potentially worth billions, while a five-day jury trial addresses these claims and Judge Maryellen Noreika oversees a related bench trial.
Arm rejects the breach-of-contract allegations, characterizing the claimed harm to Qualcomm's deals as speculative, and contends that Qualcomm itself leaked confidential antitrust information to reporters, barring recovery of damages.
Although their licensing agreement remains in effect until 2033, Arm has appealed a 2024 verdict to the United States Court of Appeals for the Third Circuit, while Judge Noreika weighs dismissing specific contract terms regarding damages.
