EU Enforces Mandatory Labelling of AI-Generated Content

Companies must mark AI-generated text, images, audio and video, while chatbots must tell users they are interacting with artificial intelligence.

  • On Sunday, August 2, the European Union's rules requiring clear labels on AI-generated content took effect, mandating companies disclose when users interact with artificial intelligence and label deepfakes.
  • Underlying the new labeling rules, makers of general-purpose AI models have carried training obligations since August 2025 requiring them to publish a 'sufficiently detailed summary' of training content and respect copyright reservations.
  • The rules include an exemption for 'artistic, creative, satirical, fictional' work, allowing disclosure through a credit rather than a prominent mark, with existing AI systems having until 2nd December 2026 to comply.
  • Streaming platforms like Deezer and Spotify have already deployed detection and tagging systems, with Deezer reporting in July that fully AI-generated music accounted for more than half of new tracks in June, receiving nearly 90,000 fully AI-generated tracks daily.
  • Copyright disputes intensified as the Munich Regional Court ruled July 31 that Suno infringed GEMA compositions, while enforcement mechanisms now include fines up to €15 million or 3% of worldwide turnover overseen by the Commission.
