- On Tuesday, July 7, former RCMP staff sergeant Damian Volk appeared in B.C. Supreme Court before Justice Terence Schultes for his second sentencing hearing, where Crown prosecutors requested a three-month prison sentence.
- The July 1, 2020 assault occurred after police arrested Jason Petrus for public intoxication at Langley RCMP; Schultes described the incident as a "thorough thrashing" where Petrus was "effectively thrown into it" by Volk.
- Defence lawyer Danielle Ching McNamee requested a conditional discharge and 18 to 24 months of probation, citing Volk's PTSD diagnosis as a mitigating factor, while Crown prosecutor Anthony Chang argued a jail sentence is necessary for a "serious breach of trust."
- In a victim impact statement, Petrus wrote that the incident left him "frightened of police," and prosecutors are seeking the same three-month sentence requested for Volk's conviction involving an August 17, 2020 assault.
- Despite the first sentencing hearing concluding in June, Schultes has not yet issued a ruling and is expected to weigh arguments from both assault proceedings before issuing a decision.
