New prosecutor to take on Georgia election case against Trump and others
Pete Skandalakis appointed himself after failing to find another prosecutor, preserving the 2023 racketeering case against Trump and others amid ongoing legal challenges.
- On Nov. 14, Pete Skandalakis, executive director of the Prosecuting Attorneys' Council of Georgia, appointed himself to State of Georgia v. Donald J. Trump, et al. after the council failed to find a replacement before Judge Scott McAfee's noon deadline.
- After appeals, the court removed Willis over a relationship with her special prosecutor; the Georgia Court of Appeals cited an "appearance of impropriety" and the state high court declined to hear her appeal in September.
- In August 2023 Fani Willis brought a sweeping RICO indictment against Donald J. Trump, President and 18 others, with four defendants already pleading guilty and the case file including more than 100 banker boxes and an 8-terabyte hard drive.
- Skandalakis now has broad discretion to continue, narrow or dismiss the charges, and if dismissed, Fulton County taxpayers could face reimbursement costs under state law regarding reimbursement for dismissed prosecutions.
- Several prosecutors declined the role when contacted by the Prosecuting Attorneys' Council, citing risks, workloads and unfamiliarity with Georgia's RICO statute, while Pete Skandalakis said charges may be impractical until 2029.
