Lawyers Take EU Council to Court over ‘Failure to Act' on Gaza
LUXEMBOURG, JUL 16 – French jurists accuse EU institutions of failing to prevent genocide in Gaza and demand suspension of cooperation with Israel amid nearly 60,000 Palestinian deaths, Jurists for the Respect of International Law say.
Jurists for the Respect of International Law filed an action under Article 265 of the TFEU on July 17 at the CJEU in Luxembourg, marking the first case against both the Commission and Council for inaction on alleged international crimes.
Following an ignored legal notice in May, Jurists for the Respect of International Law invoked EU duties to prevent genocide, uphold Palestinian self-determination, and avoid aiding unlawful occupation.
Figures reveal arms breaches; Palestinian deaths now surpass 51,000, including 20,000 children, and continued arms exports violate the Arms Trade Treaty and the EU’s Common Position 2008/944/CFSP.
The group asks the CJEU to suspend cooperation with Israel and adopt targeted sanctions, while also calling to cut all ties, acknowledge the risk of genocide, and impose sanctions as done against Russia.
While EU ministers stalled this Tuesday, Spain, Belgium, Italy and Canada have imposed full arms embargoes in line with ICJ measures.
