Florida prosecutors seek death penalty for Nathan Holmberg, indicted on 25 counts including seven capital sexual battery charges involving multiple child victims, under new 2023 state law.
- On Wednesday, Florida Attorney General James Uthmeier announced the state will seek the death penalty against Nathan Douglas Holmberg, 36, after a Hernando County grand jury indicted him on 25 counts including seven counts of capital sexual battery on children under 12.
- On Oct. 20, an unnamed good Samaritan alerted authorities, prompting forensic detectives Vasilero and Weston to recover more than 650 photos and videos and arrest Nathan Douglas Holmberg.
- The victims are between the ages of three and 10, with investigators saying more than 50 files depicted capital sexual acts involving three victims and detectives found 30 additional electronic devices.
- Holmberg is being held without bond as prosecutors say, `This evidence shows that he engaged in sex abuse with a three-year-old. Not only did he engage in these horrific physical acts, but he also filmed them. There are at least five or six victims out there,` Uthmeier stated.
- The case raises a legal question tied to Kennedy v. Louisiana as Attorney General James Uthmeier urged the U.S. Supreme Court to re-evaluate the 2008 precedent, while a statewide special task force leads the multi-jurisdictional probe.
